It has been a while. 1 year 4 mths to be exact.
Parties willing then had availed themselves to be bound by the terms and conditions implicit in the meeting of minds.
Obligations formed and discharges, breaches happened waived and forgotten.
Was there a termination clause forgotten? It is an obligation always to waive the breach?
Is there a price to pay at the end of the day, is all expected to perform everything regardless?

Fatigue.
